Attorney Marc Toberoff has filed for dismissal of Warners’ case against him, alleging that it was not filed until the statute of limitations had expired.  The suit was filed by Warners in 2010, alleging that Toberoff had interfered with agreements between the studio and the heirs of Superman creators Jerome Siegel and Joe Shuster (see "Studio Sues 'Superman' Mouthpiece").  A March hearing was requested.
Warners scored a decisive win in the 9th Circuit Court of Appeals in the core litigation last month (see "Warner Bros. Scores Another Big Win in 'Supes' Case").  Unless the case is appealed to the Supreme Court, the key case has been decided.  Now a number of Warners motions are due to be heard, including one requesting sanctions against Toberoff for suppressing evidence, and a request for attorneys’ fees from Toberoff due to Warners’ win.
