The Walking Dead creator Robert Kirkman’s LLC has filed for summary judgment to block an attempt to open a Walking Dead health food restaurant in New Jersey, according to The Hollywood Reporter. The restaurant is one of several uses for which a group of New Jersey individuals, Philip, Steven, and Anna Theodorou, have applied for Walking Dead trademarks, according to the lawsuit.
Beginning in January 2014, the group applied for "Walking Dead" marks for restaurant services, food and beverage items, cups, mugs, and drinking glasses, lipstick, and shirts.
Robert Kirkman, LLC has filed suit for unfair competition, trademark dilution, and unfair trademark practices, and is asking for summary judgment. Kirkman has extensive The Walking Dead trademarks, a line of products bearing the mark, and a licensee, AMC, with its own line of licensed merch based on the TV show.
The suit notes that the defendants have filed for a number of other trademarks associated with others, including "No Sleep Till Brooklyn" (the name of a beastie boys song), "Make America Great Again" (Donald Trump’s presidential campaign slogan), "Zombie Cinderella," and "Brooklyn Islanders."
