Dynamite Entertainment has filed a motion asking the court to order a rush hearing on its June motion to order Diamond to pay past due post-petition invoices (see "Dynamite Asked Court to Order Diamond to Pay"). "Dynamite, a small company with less than 30 employees, does not have the funds to make payroll next week, if it is not promptly paid by the Debtor," according to the motion.
The motion notes the amount Dynamite is owed, which has grown from around $509,000 at the time of the original motion on June 13 to over $1 million this week, and the amounts owed other publishers. "Dynamite is currently owed over $1 million for shipments made to the Debtor and Ad Populum LLC, a majority of which are administrative expenses," the motion said. "Dynamite is aware of multiple other publishers who remain unpaid for millions of dollars of shipments post-petition."
Dynamite asks that the expedited hearing on its motion to force payment be held on either July 3 or July 7. The bankruptcy court has ordered a hearing on Wednesday, July 2 on the motion to expedite the hearing on payments.
Diamond filed an objection to Dynamite's original motion, arguing that it has unspecified offsets to Dynamite’s invoices and that there's no rush because, "Dynamite has not demonstrated that it will suffer any hardship should it not receive immediate payment."
According to Dynamite's motion, there has been no communication regarding potential offsets, or a resolution to the request for payment since the mid-June events.
