The Upper Deck Company has announced that Upper Deck and Major League Baseball have mutually agreed to settle the lawsuit brought by Major League Baseball against Upper Deck (see “MLB Sues Upper Deck”). Under the terms of the settlement agreement Upper Deck has agreed not to use MLB trademarks including team names and logos on its trading cards going forward.
However, under the terms of the settlement Upper Deck will be allowed to sell three recently released baseball products, 2009 Signature Stars, 2009 Ultimate Collection, and 2010 Upper Deck Series 1. The Signature Stars and Ultimate Collection products had been singled out by Major League Baseball in MLB’s original complaint as containing “unauthorized” uses of team logos.
