
Frank Frazetta has filed suit against Vanguard Publishing and Vanguard publisher David Spurlock over promotion for Vanguard’s Frazetta Definitive Reference book. Vanguard solicitation material (including the text in the April Diamond Previews) carried the statement that the book was endorsed by Frazetta; the suit alleges that no agreement exists between Frazetta and Vanguard or Spurlock.
The suit was filed in the Supreme Court of the State of New York, County of New York, under the state's Civil Rights Law, which protects an individual’s right to privacy, and prohibits using a person’s name, likeness, etc. in advertising without permission.
The suit asks that Vanguard be prevented from using Frazetta’s name, image, or likeness to sell the book, for $2 million in compensatory damages, and $500,000 in exemplary damages.
Vanguard has not responded to a request for comment prior to this article's publication.
