Marvel and 20th Century Fox are negotiating over the fate of Daredevil, which Fox has until October 10th to begin filming to avoid losing the rights, according to Variety.  Fox is in talks with director Joe Carnahan, who has a "Frank Miller-esque, hardcore 70s thriller" concept, according to the report.  But even if Carnahan were signed almost immediately, it would be almost impossible for Fox to be in production by October. 

So Fox and Marvel are discussing a couple of options, according to the report, which include co-financing the Daredevil reboot.  Variety is also reporting that a swap for Galactus and the Silver Surfer, which Fox has the rights to as part of its Fantastic Four deal, is being discussed, which Fox would give back to Marvel in exchange for more time to get Daredevil into production. 

But Fox would never give up those rights, Deadline says, because of the importance of those characters to its plans for Fantastic Four, which is close to production with director Josh Frank (see "Fox Pushes 'Fantastic Four,' 'Daredevil' Reboots").  Deadline says Fox is more likely to let the rights revert to Marvel unless Marvel agrees to co-finance the film.
