Diamond Comic Distributors and subsidiaries, including Alliance Game Distributors, will be sold to Alliance Entertainment, according to a filing in the bankruptcy case today. Although Alliance Entertainment was declared the winner on the day of the bankruptcy auction, Diamond attempted to change the winner to a joint bid from Universal Distribution and WizKids and NECA parent Ad Populum, LLC, which resulted in a lawsuit by Alliance Entertainment last weekend (see “Alliance Entertainment Sues Diamond”). A hearing was held on that issue and other matters this week, and the filing referred to the results.
According to the filing today, on a deadline date move, at the hearing “…the Court indicated that it was prepared to enter an order approving the sale of substantially all of the Debtors’ assets to Alliance Entertainment, LLC, upon the Debtors’ submission of a final form of order and revised asset purchase agreement consistent with statements made on the record at the Sale Hearing.”
We await the order from the Court, but it appears the decision has been made.
