The 9th Circuit Court of Appeals confirmed on Wednesday the district court ruling which issued a temporary restraining order against Global Asylum and its mockbuster film Age of the Hobbits, according to The Hollywood Reporter.
Global had changed the name of its direct-to-DVD film to Clash of Titans after an injunction was issued back in 2012 (see "'Hobbit' Mockbuster Changes Name"). This ruling affirms that Global did not have the right to use the word “hobbits,” which it had argued was fair use tied to the term’s use in describing the discovery of a new human subspecies in Indonesia in 2003. Global released the film on DVD under the new title last December.
